Country Weathervanes and the parent company, Global Stores Direct LLC, will be known as the "Seller" and/or "we" and/or "us" and/or "our". The terms of this agreement become active when a Customer places an order with the Seller, pursuant to the laws of the State of Florida. SHIPPING We only sell the finest weathervanes and cupolas that money can buy. Remember our weathervanes and cupolas are not mass produced - they are works of art and sometimes your order may take a little longer than anticipated. Please be understanding, and we promise to keep you informed throughout the process and quickly let you know if there are any unexpected delays. Our weathervanes usually ship in 5 - 10 business days, and our WhiteHall Products weathervanes usually ship in 2 weeks, but we make no guarantees as to when your order will ship. Our handmade cupolas usually ship in about 14 - 20 business days. The products we carry are hand-made and we cannot guarantee the time when the product will be available, or when it will be shipped, but we will notify you of any delays. Because our products are custom made to order (including cupolas and weathervanes) your credit card will be charged at the time you place your order. Shipping charges will be added to your order during checkout, however, in the case of cupolas, the actual shipping charges may be different from what was calculated. Be advised that we only charge you what UPS or the motor freight company charges us for shipping your order. You will be notified of any additional shipping charges before your order is shipped (for your approval). Please note that some large or very heavy orders (all cupolas over 30" square) may require shipment via common carrier motor freight (truck). If you are ordering a cupola that has to be shipped via motor freight, please Contact Us and give us your state and zip code for a better estimate of what the motor freight charges will be. Damaged in Transit: In the rare event that an item arrives damaged, please refuse shipment if damage to the product is obvious. If you decide to accept the delivery, have the driver sign and make a note of the damage on the shipping label. The damage must be noted with the carrier, or you will be responsible for any damage claims. If you accept the delivery and find that the damage is concealed, you must file a claim within three days with the carrier (UPS, FedEx or Motor Freight). The Seller is not responsible for damage claims made after three days of delivery. After the claim is successfully settled by the carrier, the Seller, at our sole discretion, will either ship a replacement or issue a full refund, but only if and when the claim is reimbursed by the carrier. We only ship inside the United States. We do not ship to U.S. Possessions, APOs, FPOs, or any other Countries.
PAYMENT METHODS
We accept the following credit cards: Visa and MasterCard. We also accept PayPal. We only accept credit cards issued by U.S. banks with billing addresses in the U.S. **Please Note:** Charges on your credit card statement will be from "countryweathervanes.com". If you need to cancel before shipment, please let us know quickly. Note: We cannot issue refunds on some special order items. Special order items (including cupolas and weathervanes) will be charged to your credit card at the time you place your order. After you order, we will send you two emails. The first is to confirm your purchase and provide you with a link where you can monitor your order status at any time. The second email is sent when your package has been shipped. Shipments to destinations in Florida will be charged Florida sales tax. ** FOR YOUR SECURITY ** Your billing name, address and phone number must match exactly what the credit card company has on file for you. We reserve the right to cancel any order that does not match these criteria. Transactions at Country Weathervanes are 100% secure with 128-bit encrypted SSL technology. Country Weathervanes does not keep your credit card number on file or use your personal information for anything except order processing and shipment. SHIPPING to an address that is different from your BILLING address may delay your order until the alternate shipping address can be verified with your bank. (You might need to contact your credit card issuer and ask them to put a notation on your account showing the alternate delivery address).
CANCELLATIONS and RETURNS No returns accepted for any reason beyond 30 days after the date the order was placed -- No Exceptions
Products (excluding custom-built products) returned in new condition, within 25 days of the order date will be charged a 20% restocking fee. Additional deductions will be made for any missing, marred or damaged items. Returned products that are not in resalable condition will not be accepted for return (except if defective, see below) and will be refused and returned to the customer at customer's expense. Custom-built products, including cupolas and hand-painted weathervanes, are sold with a No Returns, No Refund policy.
How do I obtain a Return Authorization (RMA) number and how long is it valid for?
Use the "Contact Us" link on our website to submit a request for a Return Merchandise Authorization (RMA) number. We are unable to accept any product returns without a valid Return Merchandise Authorization (RMA) number. RMA numbers are valid for 10 days from the date of issue - please ensure that your return is postmarked within this time period or your return will be refused and no credit issued.
Returned products must be received at the seller's warehouse within 25 days of the order date to qualify for refund or replacement. Items received after 25 days of ordering will be refused and returned to customer at customer's expense and no refund will be issued. All returns must have a valid RMA number obtained by contacting Country Weathervanes via the "Contact Us" link on our website. Returned product must have a valid RMA number written on the shipping label or package. Return shipments without a valid RMA number will be refused. Customer is responsible for return shipping charges to seller's warehouse. Customer is responsible for loss or damage to products being shipped for return, therefore we advise that insurance be purchased from the carrier.
Orders cancelled before they are shipped will be issued a full refund, unless the order was a custom item (made to order) like a hand-painted weathervane or cupola. Cancellation of custom items will incur a 15% restocking fee. Once an item has been shipped, customers are responsible for shipping charges, both ways, and possible restocking fee. Cancellation requests must be made via our support ticket system - "Contact Us" link. We will email the customer a cancellation confirmation. Orders are not cancelled until the customer receives a cancellation confirmation.
Order Cancels/Refused Shipments - Once shipped from the Seller, orders may not be canceled. Customers who refuse shipment are liable for a 20% restocking fee along with the shipping costs of the order.
Any defective product: The Seller must be notified of any defective product within 15 days of delivery for replacement with an identical item. If the customer declines the replacement of the defective item and prefers to return it for refund, the order will be subject to the standard 20% restocking fee. After 15 days of delivery, all defective product claims must be directed to the manufacturer or warranty provider for evaluation and support under the manufacturer's warranty and returns policy. The defective return must include the manufacturer’s packaging and everything the manufacturer’s package originally contained. The customer pays the return shipping of the defective item and the Seller pays for Ground shipping of the replacement. We will test and confirm the defect and ship a replacement as quickly as possible, although this process can take at least 10 days to complete. If the product is deemed not defective, it will be returned to the customer with a return shipping charge. Defective products will be replaced with the same product and will not be exchanged for a different product. If the customer decides to return a defective product for a refund rather than receive a replacement product, the return will be subject to our 20% restocking fee.
Lost or Stolen packages: The customer understands and agrees that the Seller will not be liable for lost or stolen packages once the package has left our store. The Seller will assist the customer by filing a claim with the carrier (UPS, FedEx or USPS), but the final determination will be made by the carrier as to whether a credit or refund will be issued. Refunds or replacements will not be made by us until the carrier has approved the claim which can take up to 30 days. If the carrier denies the lost or stolen package claim, we will not issue any credit or refund. If a package is stolen, please contact us immediately through our Support System. Also, check to see if the package was left with a neighbor.
Excluded Items: The following items have a NO RETURNS - NO REFUNDS policy and will not be accepted for return for any reason: ALL custom-built products including cupolas and hand-painted weathervanes.
Payment Disputes / Frivolous Chargebacks / Non-Payment: Non-payment of any funds owed to the Seller will be turned over to a collections agency to recover amounts unpaid, plus fees and interest. By placing an order with the seller, the customer agrees to pay any and all court costs, legal fees and attorney fees incurred by the seller in the event of any legal action initiated by us, or by the customer, with litigation to take place in the courts of St. Lucie county, Florida. Warranty If a product requires repair, either Warranty or otherwise, the customer should contact the manufacturer directly - Country Weathervanes does not do repairs, however, we will assist you in any way we can. All Warranty repairs and replacements are made totally at the discretion of the manufacturer under their terms. Most of our products are made by Good Directions and WhiteHall Products. All prices, specifications and product availability are subject to change without notice.
Disclaimer of Liability By purchasing any product from Country Weathervanes, a division of Global Stores Direct LLC, the customer agrees to our Terms and Conditions, and our Liability clause: Country Weathervanes, Global Stores Direct LLC, its owners, employees and representatives are not responsible for the proper use or installation of any product. The products we carry are hand-made and we cannot guarantee the time when the product will be available, or when it will be shipped. Special order items (including cupolas) will be charged to your credit card at the time you place your order. The customer assumes all responsibility for the proper use and installation of all products. The customer assumes all liability for any damages to people and/or physical property in the use and installation of all products purchased from Country Weathervanes and Global Stores Direct LLC. Country Weathervanes and Global Stores Direct LLC are not responsible in any form, directly or indirectly, for damages or injuries to people or damage to personal property arising from the purchase of any products from Country Weathervanes and Global Stores Direct LLC. The sole responsibility for the proper use and installation of products purchased from Country Weathervanes and Global Stores Direct LLC, rests entirely on the customer, or his representative, who purchases our products, or the person(s) who uses or installs our products. By completing your order, you agree that Country Weathervanes is not responsible for the accuracy of product descriptions made by the manufacturer of any product and that neither Country Weathervanes or Global Stores Direct LLC assume any liability for any damages, directly, indirectly, or incidentally resulting from the purchase or use of any product purchased. If you fall off the roof or injure yourself while mounting a weathervane or cupola - it's not our fault. The customer, his survivors, and assigns agree not to hold Country Weathervanes or Global Stores Direct LLC responsible for any damages, and the customer agrees to pay for any and all court costs and legal fees resulting from any litigation or law suits filed against Country Weathervanes, Global Stores Direct LLC, its owners, employees or representatives. Any legal claims or litigation must be filed in St. Lucie County Florida. Fraudulent charge backs against Global Stores Direct LLC may require legal action to recover funds reversed by the issuing bank or credit card company involved in the transaction. Our remedy may include litigation in court and the customer agrees to pay all legal fees and court costs associated with a claim by Global Stores Direct in St. Lucie county Florida Small Claims court.Country Weathervanes is not responsible for pricing errors and typographical errors or the accuracy of product photographs. Hand painted weathervanes may look different than the product photograph. All Prices and Terms subject to change without notice. In case of an unexpected price increase, we will request your approval before proceeding with your order.
